1. Acceptance of Terms

These Website Terms and Conditions (the “Terms”) govern your access to and use of www.russellfischer.com, purchases made through the website, purchases made on site, unlimited membership plans, wash packages, gift cards, and all car wash services provided by Russell Fischer (collectively, the “Services”).

For purposes of these Terms, “Russell Fischer,” “we,” “us,” and “our” refer to Russell Fischer and its applicable locations, owners, operators, employees, contractors, agents, and affiliates. “Customer,” “Member,” “you,” and “your” refer to each person who accesses the website, purchases or uses Services, enrolls in a membership, drives or rides in a vehicle on our property, or otherwise uses a Russell Fischer location.

By using the Services, you agree that you have read, understand, and accept these Terms. If you do not agree, do not use the website, purchase or use the Services, enter the car wash tunnel, or enroll in an unlimited membership. Posted signage, attendant instructions, enrollment forms, and these Terms are all part of the customer agreement. If safety signage or an attendant instruction conflicts with any written term, the safety signage or attendant instruction must be followed.

2. Services, Website Purchases, and Wash Results

Exterior wash services. Russell Fischer provides express car wash services and related products. Services, features, pricing, hours, and availability may vary by location, package, weather, equipment condition, maintenance, staffing, volume, holidays, or other operational conditions.

No guaranteed result. Regular washes and standard wash packages may not remove hard water spots, bird waste, weather damage, tree sap, road tar, overspray, oxidation, paint defects, old stains, embedded contaminants, or other environmental damage.

Service suitability. To the fullest extent permitted by applicable law, Russell Fischer does not represent or warrant that any Service is suitable for every vehicle, vehicle condition, aftermarket item, accessory, finish, paint condition, wrap, coating, or modification.

As-is availability. The website, memberships, wash packages, gift cards, and Services are provided on an “as is” and “as available” basis, except as expressly required by applicable law or expressly stated in writing by Russell Fischer.

3. Driver Responsibilities and Tunnel Instructions

You, the customer and driver, remain in the care, custody, and control of your vehicle while entering, moving through, and exiting the express car wash tunnel. You are responsible for knowing whether your vehicle can safely use the tunnel and for asking a Russell Fischer attendant before entering if you are unsure.

Before and during tunnel use, you must:

• Follow all posted signs, lane markings, attendant directions, and safety instructions immediately.
• Have current vehicle insurance, and ensure the driver has a valid driver’s license.
• Place the vehicle in neutral when instructed and keep the vehicle in neutral until instructed otherwise or until the tunnel exit requires action.
• Do not brake, steer, accelerate, change gears, use auto-hold/brake-hold, or activate wipers or antennas while in the tunnel unless specifically instructed by a Russell Fischer attendant.
• Keep hands off the steering wheel when instructed and allow the conveyor and equipment to guide the vehicle.
• Maintain control of children, pets, and passengers and ensure all passengers remain safely inside the vehicle unless instructed otherwise.

You are responsible for all damage, costs, repairs, losses, claims, and injuries caused by your negligence, recklessness, failure to follow instructions, failure to disclose a restricted vehicle condition, or failure to remove or secure vehicle parts, accessories, cargo, debris, or personal items.

4. Vehicle Preparation Requirements

Before entering the car wash tunnel, you must prepare your vehicle as follows:

• Remove, retract, lower, or secure all antennas, including removable antennas and non-standard antenna equipment.
• Fold in side mirrors and confirm that mirrors are secure and functioning properly.
• Remove magnets, decals, decorations, temporary attachments, flags, signs, and exterior accessories that may loosen, detach, or catch on equipment.
• Remove tire covers, roof racks, bike racks, luggage racks, ladder racks, rear-mounted racks, and similar attachments unless a Russell Fischer attendant expressly approves the vehicle for entry.
• Clean out pickup beds completely. Truck beds must be empty and free of debris, tools, trash, cargo, loose materials, and unsecured items.
• Turn automatic wipers off, secure rear wipers, and disable rain-sensing wiper functions.
• Turn off auto-hold, brake-hold, automatic braking, and similar features when required for safe tunnel operation.
• Turn the vehicle into car wash mode if the vehicle is equipped with a car wash mode or similar manufacturer-recommended tunnel setting.
• Close all windows, sunroofs, convertible tops, tailgates, doors, hatches, trunks, and fuel doors completely.
• Remove or secure any loose, cracked, damaged, improperly installed, aftermarket, custom, or protruding part before entering the tunnel.

5. Vehicle Restrictions

The following vehicles and vehicle conditions are not permitted in the express car wash tunnel and may be refused service. Russell Fischer may also refuse any vehicle that, in our judgment, presents a safety risk, equipment risk, or damage risk.

Height / clearance	Lifted trucks or vehicles with clearance of 7 feet 6 inches (7’ 6”) or higher.
Low clearance	Lowered vehicles or vehicles that sit 5 inches or lower to the ground.
Tires / wheels	Vehicles with mud tires, tires wider than 12.5 inches, dual rear tires, wheel covers or caps that are loose or unsafe, or extended valve stems.
Truck beds	Trucks with uncovered beds that are not completely empty and free of any debris, cargo, tools, trash, or loose materials.
Fuel tanks / onboard equipment	Trucks with beds containing fuel tanks or vehicles with onboard fuel tanks or external equipment that may contact tunnel equipment.
Mirrors	Vehicles with permanently affixed tripod-style mirrors, non-folding mirrors, custom mirrors, or loose/damaged mirrors.
Racks / mounted accessories	Vehicles with bike racks, rear-mounted racks, large ladder racks, ladders, roof racks, luggage racks, light bars, or similar equipment that cannot be removed or safely secured.
Aftermarket or protruding parts	Vehicles with any aftermarket part, custom part, accessory, attachment, or modification that sticks out, is loose, or may contact tunnel equipment.
Other unsafe condition	Any vehicle with a condition, cargo, modification, or feature that Russell Fischer determines may damage the vehicle, another customer’s vehicle, Russell Fischer property, or car wash equipment.

6. Damage, Liability, and Claims Disclaimer

Use of the express car wash tunnel involves moving equipment, water, brushes, blowers, conveyor systems, and interaction with customer-operated vehicles. To the fullest extent permitted by applicable law, Russell Fischer is not responsible for damage, loss, claims, or injuries related to or arising from any of the items or conditions listed below.

6.1 Items and conditions washed at customer’s risk

Risk Area	Examples
Pre-existing condition	Pre-existing damage, loose parts, worn parts, rust, oxidation, cracked parts, improperly installed parts, weakened adhesives, brittle plastic, failing seals, or prior repairs.
Windshields / glass	Windshield chips or cracks, windshield crack expansion, glass defects, sunroof defects, window defects, or water intrusion from defective or open windows, doors, seals, or sunroofs.
Age-related risk	Vehicles more than five (5) model years old, including age-related part failure, weakened trim, worn components, oxidation, failing seals, or brittle parts.
Accessories and exterior parts	Fixed roof-mounted satellite antennas, antennas, wiper blades, rear wipers, spoilers, bug shields, emblems, badges, side mirrors, non-folding/custom mirrors, molding, tire covers, wheel covers/caps, and similar items.
Aftermarket / modified vehicles	Aftermarket parts, non-factory parts, altered or modified vehicles, lifted vehicles, lowered vehicles, wraps, special coatings, custom paint, non-factory trim, protruding accessories, extended valve stems, and similar modifications.
Convertible / soft-top vehicles	Convertible tops, soft tops, plastic window covers, vinyl windows, removable tops, and water intrusion or wear related to these features.
Unsecured items	Valuables, personal belongings, loose items, cargo, debris, items left in truck beds, items left in or on the vehicle, or items left on site.
Environmental or paint issues	Hard water spots, bird waste, weather damage, tree sap, road tar, overspray, paint defects, fading, oxidation, or other environmental or pre-existing surface conditions.
Customer operation	Braking, steering, accelerating, shifting out of neutral, using auto-hold/brake-hold, activating wipers, failing to use car wash mode, failing to follow instructions, or other customer driving behavior.
Other customers	Damage, loss, or injury caused by another customer, another customer’s vehicle, another customer’s unsecured item, or another customer’s failure to follow instructions.

6.2 Claim reporting requirement

You must inspect your vehicle before leaving Russell Fischer property.

Any damage claim must be reported to a Russell Fischer manager before the vehicle leaves the property and before any repair or alteration is made.

Claims reported after the vehicle has left the property will not be accepted because Russell Fischer cannot verify the condition of the vehicle after departure.

Submitting a claim does not mean Russell Fischer accepts responsibility. All claims are subject to investigation, review of vehicle condition, and review of compliance with these Terms and onsite instructions.

6.3 Customer responsibility for damage to property or persons

If your vehicle, vehicle condition, cargo, accessories, actions, omissions, negligence, recklessness, or failure to follow instructions causes damage to Russell Fischer equipment, Russell Fischer property, another customer’s vehicle, another customer’s property, or injury to any person, you are responsible for all resulting costs, repairs, losses, claims, and expenses to the fullest extent permitted by applicable law.

6.4 Limitation of liability and indemnification

To the fullest extent permitted by applicable law, Russell Fischer will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of use, lost profits, diminished value, or inconvenience, arising out of or related to the Services, website, membership plans, wash packages, gift cards, or these Terms.

You agree to defend, indemnify, and hold harmless Russell Fischer from and against claims, damages, losses, liabilities, demands, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your breach of these Terms, misuse of the Services, unsafe operation of a vehicle, failure to follow instructions, prohibited or unsafe vehicle condition, negligence, recklessness, or damage or injury caused by you, your vehicle, your passengers, your personal property, or your unsecured items.

Nothing in these Terms is intended to waive or limit rights, remedies, responsibilities, or liabilities that cannot be waived or limited under applicable law.

7. Unlimited Membership Terms and Conditions

This section applies to monthly unlimited membership plans and any other recurring wash plan offered by Russell Fischer. By enrolling in a membership, you authorize Russell Fischer or its payment processor to charge your payment method immediately and on a recurring monthly basis according to these Terms.

7.1 Billing authorization and automatic renewal

The first membership charge is processed immediately at the time of purchase or enrollment.

After enrollment, the membership automatically renews monthly and your payment method will be charged on the monthly anniversary date of your purchase, or the closest available processing date when necessary.

You authorize Russell Fischer and its payment processor to store and charge your payment method for recurring membership charges, applicable taxes, and any applicable fees.

You represent that you are authorized to use the payment method provided and that all enrollment information is accurate and complete.

7.2 Cancellation

All unlimited membership plans require 30 days’ cancellation notice.

You may submit a cancellation request through the Plan Maintenance section at www.russellfischer.com, by submitting a Cancellation Form in person, or by contacting memberships@russellfischer.com.

Cancellation is not effective until the required 30-day notice period has been completed and the cancellation has been processed by Russell Fischer.

Charges scheduled to occur during the 30-day cancellation notice period may still be processed.

Stopping use of the membership, selling the vehicle, removing a sticker or barcode, disputing a charge, or failing to update payment information does not automatically cancel the membership.

7.3 Refunds and final sale policy

All sales are final.

No refunds, partial refunds, prorated refunds, credits, or cash redemptions will be issued after a membership purchase, renewal charge, wash package purchase, gift card purchase, or other online purchase, except where required by applicable law.

Temporary closures, weather delays, equipment downtime, maintenance, holidays, staffing limitations, service interruptions, or failure to use the membership do not entitle a Member to a refund, credit, or billing extension, except where required by applicable law.

7.4 Vehicle-specific use

Memberships are intended for one registered vehicle and may not be shared, resold, transferred, duplicated, or used for multiple vehicles without Russell Fischer’s prior approval.

If a license plate, barcode, RFID tag, account credential, or other access method is used for membership identification, it may be used only for the registered vehicle associated with the membership.

Members must notify Russell Fischer of any change in vehicle ownership, registered vehicle, license plate, contact information, or payment information.

Using a membership on an unauthorized vehicle, swapping plates, sharing credentials, or attempting to avoid proper charges may result in suspension or termination without refund, to the fullest extent permitted by applicable law.

7.5 Price changes, payment issues, and program changes

Russell Fischer reserves the right to adjust membership pricing with 30 days’ notice sent to the contact information provided by the customer or otherwise provided as permitted by applicable law.

You are solely responsible for keeping accurate contact, billing, vehicle, and payment information on file.

If a payment is declined, expired, charged back, or otherwise not processed, Russell Fischer may suspend or terminate the membership and may continue to attempt payment as permitted by applicable law.

Russell Fischer reserves the right to modify, suspend, or discontinue any membership plan, feature, package, promotion, location participation, or program rule, subject to applicable law.

8. Wash Package and Gift Card Purchase Terms and Conditions

Wash packages and gift cards purchased on the website will be emailed to the contact information provided at the time of purchase.

The customer is responsible for entering accurate recipient, purchaser, email, phone, vehicle, and payment information at the time of purchase.

If incorrect contact information is provided, Russell Fischer may attempt to locate the purchase using the customer name, purchaser information, sale ID, or other available transaction information; however, Russell Fischer is not responsible for delays or failed delivery caused by inaccurate information.

All online purchases are non-refundable, except where refunds are required by applicable law.

Gift cards, wash packages, promotional certificates, and other stored-value or prepaid items are not redeemable for cash except where required by applicable law.

Lost, stolen, damaged, deleted, forwarded, misdirected, or unauthorized-use gift cards or wash packages may be replaced only if Russell Fischer can verify the original purchase and remaining balance or unused value.

9. Refusal of Service, Suspension, and Service Availability

Russell Fischer reserves the right to refuse service to any customer or vehicle for safety, operational, equipment, customer conduct, payment, vehicle condition, or policy reasons.

Russell Fischer may refuse, suspend, or terminate service, a membership, or access to the property for abusive conduct, unsafe conduct, fraud, misuse, failure to follow instructions, violation of these Terms, chargebacks, payment issues, or any conduct that may harm customers, employees, vehicles, equipment, or property.

Car wash services may be unavailable or limited due to weather, maintenance, cleaning, repairs, equipment failure, holidays, staffing, power or utility issues, government restrictions, emergencies, capacity, safety concerns, or other circumstances beyond Russell Fischer’s control.

Not all Services, packages, promotions, prices, or features may be available at all times or at every location.

10. Communications, Account Information, and Privacy

By enrolling in a membership, purchasing online, or providing contact information, you agree that Russell Fischer may contact you using the email address, phone number, mailing address, or other contact information you provide for account, billing, operational, transactional, safety, service, and membership-related communications.

Marketing communications will be sent only as permitted by applicable law and may be subject to separate consent and opt-out rules. Opting out of marketing messages does not prevent Russell Fischer from sending non-marketing account, billing, transaction, safety, or service-related communications.

You are responsible for keeping all account, contact, vehicle, and payment information accurate and current.

Use of the website and collection, use, and storage of personal information are also governed by Russell Fischer’s posted Privacy Policy, if any, and by applicable law.

Online payments may be processed by third-party payment processors. Russell Fischer is not responsible for third-party systems except to the extent required by applicable law.

11. Updates to These Terms

Russell Fischer may update, revise, or replace these Terms from time to time. Updated Terms may be posted on www.russellfischer.com, provided during enrollment, posted at a location, or otherwise communicated as permitted by applicable law. Continued use of the website, Services, car wash tunnel, wash packages, gift cards, or membership after updated Terms are posted or provided constitutes acceptance of the updated Terms. Membership price changes will be handled as described in Section 7.5.
